Alberta's second Information and Privacy Commissioner appointed in 2002

Mr. Work was born in Calgary, received his Bachelors Degree in Political Science and Masters Degree in Environmental Design from the University of Calgary and obtained a law degree in 1981 from McGill University. He practiced corporate commercial law in Calgary, worked for the Attorney General of Bermuda, and was seconded to the United Nations Environmental Program.

After returning to Canada in 1987, Mr. Work took a contract position with the World Bank and was assigned to the country of Mauritius.

From 1991 to 1996 Mr. Work worked as Parliamentary Counsel to the Legislative Assembly of Alberta, and General Counsel to the Ethics Commissioner of Alberta. In 1996 Mr. Work began his career at the Office of the Information and Privacy Commissioner as General Counsel and Assistant Commissioner. Mr. Work was appointed to a five-year term as Information and Privacy Commissioner in May 2002.

In November 2005 British Columbia’s Legislative Assembly unanimously appointed David Loukidelis to a second six-year term as Information and Privacy Commissioner. An independent officer of the Legislature, he oversees compliance with British Columbia’s Freedom of Information and Protection of Privacy Act, Personal Information Protection Act and Lobbyists Registration Act.

David's experience in access and privacy issues goes back to 1990. Since becoming Commissioner in 1999, he has written hundreds of access to information appeal decisions, privacy complaint decisions, reports and policy materials.

David's teaching experience includes teaching access to information and privacy law at the University of Victoria.

Learning Where You've Been without Knowing Who you Are

This talk presents a method for tracking people over time while maintaining privacy. An example application is tracking individuals who receive social services ­ where they go and what they receive. Some believe doing so may help government agencies reduce costs. Yet, the privacy issues for some social service clients are paramount. For example, domestic violence shelters have historically had to protect clients from intimate and aggressive abusers. Husbands, boyfriends, and exes are the murderers of over 31% of all women murdered in the United States. The majority occur after an attempt to leave an abusive relationship. Including location information about domestic violence shelter clients in a computer system that tracks clients poses grave privacy concerns.

This talk introduces a provable privacy-preserving system (P3Tracker) for gathering service utilization patterns of domestic violence shelter clients while guaranteeing the privacy of shelter clients. Learned information from patterns specific to each person includes sleeping locations, meals received, health and other services obtained over time. While the government learns personal utilization patterns, the government does not learn the identity of the clients, and the likelihood of a successful attack from an intimate stalker is not increased.

Aside from being the Director of the Privacy Technology Center at Carnegie Mellon University, Dr.Sweeney is one of the world's leading experts and researchers on Privacy Technologies.
Her primary research concern involves the development of algorithms that learn strategic and sensitive information typically across disparate, non-homogeneous data sources. A natural application area for this research is in privacy research, both in (1) determining the extent to which private information can be identified through systematizing facts and principles using generalized methods and semantic learning algorithms, and in (2) developing techniques, algorithms and technology to limit what can be learned and to sufficiently anonymize information and control data sharing. Her work has received awards from numerous organizations, including the American Psychiatric Association, the American Medical Informatics Association, and the Blue Cross Blue Shield Association. She has also testified before the Privacy and Integrity Advisory Committee of the Department of Homeland Security and the European Union Commission. Companies have licensed and continue to use her privacy technologies. Dr. Sweeney is an Associate Professor of Computer Science, Technology and Policy in the School of Computer Science at Carnegie Mellon University, where she also founded and serves as the Director of the Data Privacy Lab.

The term "employee monitoring" covers a host of activities including video surveillance, email monitoring, keystroke monitoring and physical tracking through GPS. Employee monitoring is an essential component of managing a safe and productive workplace. Where do you strike the balance between workplace surveillance and workplace privacy? How can the privacy issues associated with different surveillance technologies be addressed? This panel will address these questions while looking at the legal issues employers need to understand when deciding whether or not to implement surveillance programs.

Gary received his Bachelor of Arts (Hons.) from the University of New Brunswick, his law degree from Queen's University in 1993 and was admitted to the British Columbia bar in 1994. Robert B. Blasina, Arbitrator/Mediator, has been arbitrating or mediating labour disputes since 1987. He hears cases from diverse employment environments, in both the private and public sector. Jill now works for the Office of the Information and Privacy Commissioner of Alberta as Senior Portfolio Officer with the PIPA Team. Laird joined the H.Y. Louie/London Drugs family in 1996 after having served the organization for the previous ten years as part of Deloitte & Touche as a Senior Manager. Kim is a senior policy analyst with the Access and Privacy Branch, Alberta Government services, which has ministerial responsibility for the Personal Information Protection Act (PIPA). Kim was closely involved in the development of PIPA and, in conjunction with the Office of the Information and Privacy Commissioner (Alberta), coordinated a series of implementation workshops for private sector organizations throughout the province. Kim has worked on the development of PIPA resources for the private sector, including the information sheet on personal employee information. Kim will be part of the technical team that will support the MLA committee appointed by the Legislative Assembly to review PIPA in 2006-07.

Born and raised in Calgary, Kim received her Bachelor of Laws from the University of Calgary in 1982. Kim practiced corporate/commercial law and was a long-time editor for a Canadian legal publishing company before joining the public service.

Det. Bob Gauthier, 27-year member of the Edmonton Police Service, presently assigned to Drug Section, one of two members of the EPS Meth Project Team.

Det. Gauthier and Vonkeman founded The Meth Project Team, to specifically target Organized Crime related to the Meth addicted offender and their crimes. Fraud, drugs, and Identity Theft related offences are the most prevalent crimes. Recent developments have seen the addition of Phishing and Trojan based computer crimes being added to this list. We have been told that we have had the first Phishing related arrest in Canada. We have been worked with the Federal Government to develop new laws in relation to Identity Theft and Computer related crime. Our investigations have lead to partnerships with: The Office of the Information and Privacy Commissioner; the US Sercet Service; all five major Canadian Banks; Calgary; Vancouver; Montreal Police Services and the RCMP.

C2: Designing & Implementing Technology

Retooling information systems without taking privacy laws into account is like building a house and ignoring building codes. Richard S. Rosenberg is a Professor Emeritus in the Department of Computer Science, at the University of British Columbia. His research interests are in the social impact of computers and in Artificial Intelligence (AI). His work in the social impact of computers includes such areas of concern as privacy, freedom of expression, intellectual property rights, universal access, work and education. He has written many papers on free speech, ethics, and privacy issues, has appeared before Federal parliamentary and provincial legislative committees, and made presentations before the U.S. National Research Council. His most recent book is The Social Impact of Computers, 3rd Edition, San Diego, CA: Elsevier Academic Press, 2004. He is also a Vice-president of Electric Frontier Canada, on the Board of the BC Civil Liberties Association, and president of the BC Freedom of Information and Privacy Association.

This raises a lot of issues about how Information and Privacy Commissioners deal with media inquiries about privacy issues, how the media cover these stories and how your organization responds to media inquiries.

Join the Alberta and British Columbia Commissioners and two reporters to discuss privacy issues and media coverage. This interactive plenary panel will discuss trends in privacy reporting, how the media views these issues and will examine tools available to Commissioners to educate the public and to enforce privacy rights. Organizations will also learn how to effectively respond to media inquiries. The Commissioners and the journalists will provide their opinions on "the biggest privacy stories" of the year.

Alberta's second Information and Privacy Commissioner appointed in 2002

Mr. Work was born in Calgary, received his Bachelors Degree in Political Science and Masters Degree in Environmental Design from the University of Calgary and obtained a law degree in 1981 from McGill University. He practiced corporate commercial law in Calgary, worked for the Attorney General of Bermuda, and was seconded to the United Nations Environmental Program.

After returning to Canada in 1987, Mr. Work took a contract position with the World Bank and was assigned to the country of Mauritius.

From 1991 to 1996 Mr. Work worked as Parliamentary Counsel to the Legislative Assembly of Alberta, and General Counsel to the Ethics Commissioner of Alberta. In 1996 Mr. Work began his career at the Office of the Information and Privacy Commissioner as General Counsel and Assistant Commissioner. Mr. Work was appointed to a five-year term as Information and Privacy Commissioner in May 2002.

In November 2005 British Columbia’s Legislative Assembly unanimously appointed David Loukidelis to a second six-year term as Information and Privacy Commissioner. An independent officer of the Legislature, he oversees compliance with British Columbia’s Freedom of Information and Protection of Privacy Act, Personal Information Protection Act and Lobbyists Registration Act.

David's experience in access and privacy issues goes back to 1990. Since becoming Commissioner in 1999, he has written hundreds of access to information appeal decisions, privacy complaint decisions, reports and policy materials.

David's teaching experience includes teaching access to information and privacy law at the University of Victoria.

Privacy Commissioner of Canada Jennifer Stoddart was appointed Canada's Privacy Commissioner by the Governor in Council, effective December 1, 2003, on unanimous resolutions adopted by both Houses of Parliament for a seven-year term.

Ms. Stoddart was previously President of the Commission d'accès à l'information du Québec, an organization responsible for both access to information and the protection of personal information, to which she was appointed upon resolution by the Quebec National Assembly in 2000.

Ms. Stoddart has held several positions in public administration for the Governments of Québec and Canada, including at the Canadian and the Quebec Human Rights Commissions.

She has been active in the Canadian Bar Association and is currently a member of the Board of Directors of the Canadian Institute for the Administration of Justice.

She has taught history and legal sciences at the Université du Québec à Montréal and McGill University. She has published for both professional journals and the wider public on questions ranging from Quebec social history to the administration of justice and human rights.

Ms. Stoddart received a licence in civil law from McGill University and was admitted to the Quebec Bar in 1981. She also obtained an M.A. in History from the Université du Québec à Montréal, and pursued doctoral studies at the Université de Paris VII.

This session focuses on the proactive assessment of privacy risks and practical solutions to the management of employee records and information systems. The Branch coordinates the administration of Alberta's Personal Information Protection Act and supports the private sector in its implementation. Hilary has been working in the field of access and privacy since 1995, first processing access requests under Alberta's Freedom of Information and Protection of Privacy Act, then coordinating the extension of that act to municipalities, schools, universities and colleges. Hilary was directly involved in the development of PIPA, and will be supporting the review of the act scheduled to begin in 2006.

Ms. Palozzi spent 30 years in the Ontario public service, holding various responsibilities in numerous portfolios. In her last assignment she was Superintendent and Chief Executive Officer of the Financial Services Commission for Ontario. As well, Ms. Palozzi has served as Deputy Minister of Revenue and Financial Institutions and Deputy Minister of Correctional Services. Heather Black is a former member of the Department of Justice, where her practice was largely in commercial law. From 2001 to August 2003 she was General Counsel at the Office of the Privacy Commissioner of Canada. Effective August 18, 2003, she was appointed Assistant Privacy Commissioner of Canada with primary responsibility for private sector privacy. As counsel to Industry Canada she worked on the development of Part 1 of the Personal Information Protection and Electronic Documents Act. She was involved in the policy development and was instructing counsel on the drafting of the Bill. David Flaherty is a specialist in the management of privacy and information policy issues. He served a six-year, non-renewable term as the first Information and Privacy Commissioner for the Province of British Columbia (1993-99). He built an office of 25 staff with an enviable record for successful mediation of access to information disputes. Flaherty wrote 320 Orders under the Freedom of Information and Protection of Privacy Act. He also pioneered the development of site visits to public bodies (hospitals in particular) as a form of privacy auditing.

His most recent articles are "Visions of Privacy: Past, Present, and Future," in C.J. Bennett and R. Grant, eds., Visions of Privacy: Policy Choices for the Digital Age (University of Toronto Press, 1999); and "Controlling Surveillance," in P. Agre and M. Rotenberg, eds., Technology and Privacy: The New Landscape (MIT Press, 1997). Dr.Flaherty has written or edited fourteen books. David is an Honours graduate of McGill University (1962) and has an MA and Ph.D. from Columbia University. His teaching career from 1965 to 1993 included Princeton University, the University of Virginia, and the University of Western Ontario, where he was professor of history and law from 1972 to 1999 and is now professor emeritus.

As a consultant, Flaherty's services for clients include strategic advice on the management of privacy issues and of relationships with privacy authorities, privacy advocates, and the general public; conducting overall assessments of privacy compliance (privacy reviews, audits, site visits); preparing Privacy Impact Assessments; and developing privacy codes to comply with the Personal Information Protection and Electronic Documents Act (and its provincial equivalents).

In the fall of 1999 Flaherty served as a Special Advisor to the Deputy Minister of Industry Canada in support of Bill C-6, the Personal Information Protection and Electronic Documents Act. Along with Stephanie Perrin, Heather Black, and Murray Rankin, Flaherty is a co-author of the Personal Information Protection and Electronic Documents Act: An Annotated Guide (Irwin Law, Toronto, January, 2001). He also co-authored the Guidelines for Managing Privacy, Data Protection and Security for Ontario Hospitals (A Report prepared by the Ontario Hospital eHealth Council's Privacy and Security Working Group – July 2003). www.oha.com

On November 4, 2003 Flaherty testified before the Standing Committee on Government Operations and Estimates of the House of Commons (with the interim Privacy Commissioner, Robert Marleau) on the qualities required for the next Privacy Commissioner of Canada in light of the nomination of Ms. Jennifer Stoddart to the post. Flaherty is also a member of the first External Advisory Committee to the Privacy Commissioner of Canada. Since 2000, he has been the Chief Privacy Advisor to the Canadian Institute for Health Information (CIHI) and is currently the Chief Privacy Advisor to Canada Health Infoway (the promoter of electronic health records).

The Privacy Impact Assessment: Analyzing and Mitigating Privacy Risk

Good privacy is good business. One way organizations maintain their trust relationship with clients, customers and employees is by enabling personal information privacy through administrative, technical and physical safeguards. Such safeguards allow businesses to move forward with specific objectives such as marketing, service delivery, and HR management while balancing the need to protect personal information from inappropriate access, collection, use or disclosure. In the drive to provide more efficient services and incorporate information technology into business processes, privacy rights may inadvertently be put at risk.

Businesses need an effective method to assess potential impacts to privacy for any existing or proposed initiative (e.g. project, service delivery option, policy, new information system) involving personal information. The Privacy Impact Assessment (PIA) allows organizations to implement new programs or information systems while balancing the need to protect personal information. A PIA:

  • Describes an initiative (new service offering, new business system, marketing scheme etc.)
  • Describes the flow of personal information
  • Identifies potential risks to privacy
  • Articulates practices or measures that will mitigate identified risks, and
  • Describes an implementation and monitoring plan for the management of personal information.

This workshop will provide you with an overview of the PIA process and will provide participants with hands-on experience in conducting a PIA. The objectives of this workshop are to:

  • Understand the PIA process
  • Identify when PIAs are required
  • Identify who should be involved in the PIA process and discuss strategies for gaining and maintaining organizational support for your PIA program
  • Conduct a personal information flow analysis and chart the workflow
  • Conduct a privacy risk analysis
  • Choose a risk mitigation plan, and
  • Chart next steps.

The workshop will follow an interactive, non-legal approach to demystifying the PIA process. Privacy Impact Assessments are required by law under Alberta's Health Information Act, and by policy in the public sector. The PIA is fast becoming a best-practice tool for the private sector in assessing risks to personal information management. Karina Guy is a Senior Manager with Deloitte & Touche LLP. She has over 10 years of specialized consulting experience in Information Risk Management, Privacy and Security. She has assisted many clients with the design and implementation of a privacy program, in addition to selecting and implementing privacy enhancing technologies such as identity management. Specific industry focus includes private-sector, government and healthcare, where Karina has been working with clients to define standards, manage risk and implement privacy controls. She has conducted numerous privacy impact assessments on programs and complex information systems for organizations across Canada; this knowledge is complimented by expertise in formal privacy audit using the Canadian Institute of Chartered Accountant's Generally Accepted Privacy Principles (GAPP). Karina holds a Masters degree from the School of Library, Archival and Information Studies at the University of British Columbia, is a Certified Information Systems Security Professional (CISSP) and a Certified Information Systems Auditor (CISA).
